Enfork Media AUP
This Acceptable Use Policy (AUP) governs the use of the products, services, and technologies (collectively referred to as “Products”) provided by Enfork Media. It is designed to protect Enfork Media, our customers, and the online community from unethical, irresponsible, and illegal activities.
Customer Responsibilities
Enfork Media customers engaging in activities prohibited by this AUP may face service suspension, account termination, and legal action if necessary. Customers are responsible for their own actions and the actions of anyone using Enfork Media Products with their permission.
Fair Use
We expect users to engage with our Products in a manner consistent with “business as usual”. Excessive use may result in additional fees or capacity restrictions. Enfork Media opposes all forms of abuse, discrimination, rights infringement, or any action that harms individuals, groups, or resources.
Customer Accountability
Enfork Media places a significant emphasis on customer responsibility, expecting customers to be accountable for their individual actions as well as for the actions of any individuals using Enfork Media Products with the customer’s permission. This responsibility extends to preventing unauthorised use by implementing and maintaining robust security measures.
Customers accepting Enfork Media Products commit to ensuring strict adherence to this Acceptable Use Policy (AUP) on behalf of anyone using the Products as their end users.
Complaints pertaining to the actions of customers or their end-users will be promptly directed to the designated contact for the respective account for resolution. In the event that a customer, their end-user, or any individual using Enfork Media Products due to the customer’s failure to implement reasonable security measures violates our AUP, Enfork Media reserves the right to take decisive actions. This includes, but is not limited to, terminating any Products associated with the offending account or the account itself, and implementing remedial or preventative measures without prior notice. In accordance with legal provisions, no credit will be available for service interruptions resulting from violations of our Acceptable Use Policy.
Prohibited Activity
Copyright Infringement and Unauthorized Material
Enfork Media Products must not be used for the transmission, distribution, or storage of any material that violates applicable laws. This includes, but is not limited to:
– Any material protected by copyright, trademark, trade secret, or other intellectual property rights used without the proper authorisation.
– Material that is deemed obscene, defamatory, constitutes an illegal threat or violates export control laws.
Customers bear sole responsibility for all content they input, upload, disseminate, transmit, create, or publish through or on Enfork Media Products. It is imperative that customers obtain legal permission to use any works included in such material to ensure compliance with intellectual property laws. Enfork Media retains the right to take appropriate actions in the event of any violation of these content-related guidelines.
SPAM and Unauthorized Message Activity
Enfork Media Products are strictly prohibited from being used for the purpose of sending unsolicited bulk or commercial messages, commonly known as “spam”, in violation of applicable laws and regulations in your jurisdiction. This prohibition includes activities such as sending spam, soliciting customers through spam originating from other service providers, and gathering responses to spam sent from external sources. Furthermore, Enfork Media Products must not be employed to manage unconfirmed mailing lists or telephone number lists, referred to as “messaging lists”.
This prohibition includes subscribing email addresses or telephone numbers to any messaging list without explicit permission from the respective owner. All messaging lists, whether hosted or run on our Products, are required to be “confirmed opt-in,” with verifiable evidence of the owner’s express permission throughout the lifespan of the messaging list.
Enfork Media strictly prohibits the use of email lists, telephone number lists, or databases procured from third parties for the explicit purpose of spamming or creating unconfirmed messaging lists on our Products.
This policy regarding spam and unauthorised message activity extends to messages sent through Enfork Media Products or from any network by the customer or any individual acting on behalf of the customer. This includes messages that directly or indirectly reference a site hosted via our Products. Compliance with this policy is essential to maintaining the integrity and ethical use of Enfork Media Products.
Unethical, Exploitative, and Malicious Activity
Enfork Media Products must not be employed for the purpose of advertising, transmitting, or otherwise making available any software, program, product, or service designed to contravene this acceptable use policy or the acceptable use policies of other service providers. This includes but is not limited to, facilitating the means to send spam and initiating network sniffing, pinging, packet spoofing, flooding, mail-bombing, and engaging in denial-of-service attacks.
Our Products must not be used to access any account or electronic resource for which the user does not own or possess proper authorisation (e.g., “hacking”, “cracking”, “phreaking”, etc.).
Intentional or reckless introduction of viruses or malicious code into Enfork Media Products and systems is strictly prohibited.
Using Enfork Media Products for activities intended to harass another group or individual is expressly forbidden. Our definition of harassment includes but is not limited to denial-of-service attacks, hate speech, advocacy of racial or ethnic intolerance, and any activity intended to threaten, abuse, infringe upon the rights of, or discriminate against any group or individual. Other activities considered unethical, exploitative, and malicious include:
- Attempting to obtain services from Enfork Media with the intent to avoid payment.
- Using our facilities to obtain or attempt to obtain services from another provider with the intent to avoid payment.
- Unauthorised access, alteration, or destruction of any information about Enfork Media customers or end-users through any means or device.
- Using Enfork Media facilities to interfere with the use of our facilities and network by other customers or authorised individuals.
- Publishing or transmitting any content or links that incite violence, depict a violent act, depict child pornography, or threaten anyone’s health and safety.
- Any act or omission in violation of consumer protection laws and regulations.
- Any violation of a person’s privacy.
Enfork Media Products may not be used by any person or entity involved with or suspected of involvement in activities or causes relating to illegal gambling, terrorism, narcotics trafficking, arms trafficking, or the proliferation, development, design, manufacture, production, stockpiling, or use of nuclear, chemical, or biological weapons, weapons of mass destruction, or missiles. This includes any affiliation with others who support the aforementioned activities or causes.
Unauthorised Use of Enfork Media Property
Enfork Media strictly prohibits any attempt to impersonate the Company, misrepresent a substantial business relationship with Enfork Media, or claim ownership of any Enfork Media property, including our Products and brand, with the intent of deceitfully acquiring services, custom, patronage, or user trust.
Any such unauthorised use of Enfork Media’s identity, assets, or brand for fraudulent purposes will result in immediate action, including potential service termination and legal consequences. We are committed to maintaining the integrity of our brand and ensuring that our users can trust the authenticity of their interactions with Enfork Media.
About this Policy
Enfork Media reserves the right to modify this AUP by publishing the revised version on our website. The revised version becomes effective when customers use Enfork Media Products after the publication date or 30 days after the revised version is published.
This policy outlines unacceptable activities incompatible with Enfork Media’s brand. Users are encouraged to review this policy regularly.
